1. Acceptance

By creating a TradeStreak account, tapping "I Agree" on the onboarding screen, or otherwise accessing or using the TradeStreak mobile application, any related website, API, or service (collectively, the "Service"), you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy, Educational Use Disclaimer, and Risk Disclosure (together, the "Agreements"). If you do not agree, do not use the Service.

These Terms constitute a binding contract between you and Provision Tech Advisors LLC, a Virginia limited liability company ("TradeStreak", "we", "us", "our").

2. Eligibility

You must be at least thirteen (13) years old to create an account, and at least the age of majority in your jurisdiction to enter into a legally binding contract without a guardian. By using the Service you represent that:

• You are the age required above;
• You have the legal capacity to accept these Terms;
• You are not barred from receiving the Service under the laws of the United States or your place of residence;
• You are not on any U.S. government prohibited or restricted-party list.

The Service is not directed to children under 13. If we learn that a child under 13 has created an account, we will delete it. See the Privacy Policy for our Children's Online Privacy Protection Act (COPPA) practices.

3. The Service — Educational Use Only

TradeStreak is an educational product. It is not a brokerage, investment adviser, broker-dealer, bank, money-services business, or any other regulated financial entity. Nothing the Service produces constitutes financial, investment, legal, tax, accounting, or other professional advice.

The Service provides, among other features:

• Interactive lessons, quizzes, and scenario simulations about investing, markets, and personal finance;
• Historical market scenarios where users make hypothetical decisions and receive educational feedback;
• An AI-generated "mentor" that explains concepts and summarizes public market news;
• A paper-trading sandbox that uses simulated balances and real-time market data for educational practice only;
• Gamification mechanics (experience points, streaks, achievements, leagues) to encourage learning consistency;
• Optional read-only linking of your external brokerage account (via third-party aggregators) so you can view your holdings alongside educational content.

3.1 No Recommendations

Any output from the Service — lesson content, scenario outcomes, AI mentor commentary, "daily market briefings", roast feedback, suggested stocks, sector breakdowns, or performance metrics — is provided for educational purposes only and is not a recommendation, endorsement, solicitation, offer, or advice to buy, sell, hold, or transact in any security, cryptocurrency, derivative, insurance product, or other financial instrument.

TradeStreak does not evaluate whether any security or strategy is suitable for your particular financial situation, risk tolerance, investment objectives, or tax circumstances. You are solely responsible for your own investment decisions.

3.2 Paper Trading and Scenarios Are Simulations

The paper-trading feature and all scenario simulations use virtual money. Any "gains" or "losses" shown are hypothetical and have no monetary value. Past performance of any simulated strategy — whether your own or another user's — does not predict or guarantee future results in real markets. Real-world trading involves substantial risk of loss, including the loss of your entire investment.

3.3 Market Data

The Service displays real-time or delayed market data sourced from third-party providers (including Polygon.io and Financial Modeling Prep). We do not guarantee that data is accurate, complete, current, or free of errors. Data may be delayed up to 15 minutes, reflect stale closes, include incorrect symbols or corporate actions, or omit splits or dividends. Never rely on data displayed in the Service for real-money trading decisions — always verify through your actual broker before acting.

4. Account Registration

To use most features you must create an account. You agree to:

• Provide accurate, current, and complete information;
• Maintain the confidentiality of your password and account credentials;
• Notify us immediately of any unauthorized use of your account;
• Be solely responsible for all activity under your account, whether or not you authorized it.

We may suspend or terminate your account at our sole discretion, with or without notice, for any reason, including violation of these Terms, suspected fraud, or failure to pay subscription fees.

5. Subscriptions, Payment, and Auto-Renewal

5.1 Free and Paid Tiers

The Service offers a free tier and one or more paid subscription tiers ("Pro Subscriptions"). Pro Subscriptions unlock additional features as described in the app.

5.2 Apple App Store

All Pro Subscriptions are billed through Apple Inc.'s App Store. By purchasing a Pro Subscription, you authorize the App Store to charge the payment method on file for your Apple ID at the subscription price shown at purchase. You also agree to Apple's Media Services Terms and Conditions.

5.3 Auto-Renewal

Pro Subscriptions automatically renew for successive periods of the same length (monthly or annual) at the then-current price, unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID within 24 hours of the period's end. You can cancel or manage subscriptions at any time in the iOS Settings app under [Your Name] → Subscriptions.

5.4 Free Trials

If offered, a free trial converts into a paid Pro Subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Cancelling during the trial retains access for the remainder of the trial period and stops future billing.

5.5 Refunds

All subscription fees are non-refundable except where required by law or where Apple's refund policy applies. Refund requests must be made directly to Apple via reportaproblem.apple.com. TradeStreak does not issue refunds directly.

5.6 Price Changes

We may change subscription prices at any time. For ongoing subscribers, a price increase takes effect at the next renewal after reasonable notice and does not apply to an in-progress billing period you've already paid for.

6. User Conduct and Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law (including securities laws, tax laws, sanctions, and export controls);
• Represent the Service's output as personalized financial advice to third parties, or use it to solicit, advise, or manage investments for anyone other than yourself;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service;
• Interfere with, disrupt, probe, or circumvent the security of the Service, including rate limits, authentication, or content protection;
• Use automated means (bots, scrapers, spiders) to access the Service except as expressly permitted;
• Copy, resell, sublicense, rent, lease, or distribute any part of the Service or its content;
• Use the Service to create a competing product, train a machine-learning model on our content, or aggregate our content for redistribution;
• Upload, post, or transmit any content that is unlawful, defamatory, obscene, threatening, invasive of privacy, infringes intellectual property, or contains viruses or malicious code;
• Circumvent or manipulate the gamification mechanics (XP, streaks, leagues, achievements) through fake accounts, collusion, scripting, or exploitation of bugs.

7. Intellectual Property

7.1 Our Content

The Service and all its content — software, lessons, scenarios, illustrations, text, designs, trademarks, logos, and compilations — are owned by TradeStreak or its licensors and are protected by U.S. and international copyright, trademark, patent, trade-secret, and other intellectual-property laws. Except for the limited license in Section 7.2, no rights are granted to you.

7.2 License to Use the Service

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own personal, non-commercial educational use on a device that you own or control. This license terminates automatically if you violate these Terms.

7.3 Your Content

If you submit any content to the Service (e.g., posts, comments, profile bio, avatars — collectively "User Content"), you grant TradeStreak a worldwide, royalty-free, perpetual, irrevocable, sublicensable, transferable license to host, copy, modify, distribute, publicly perform, and publicly display that User Content in connection with operating and promoting the Service. You represent that you own or have the right to grant this license for all User Content you submit.

7.4 Feedback

If you provide suggestions, ideas, or other feedback about the Service, you grant TradeStreak an unrestricted right to use that feedback without compensation or attribution.

8. Third-Party Services

The Service integrates with third-party providers, including but not limited to Apple Inc. (App Store, Sign in with Apple, StoreKit), SnapTrade or Plaid (brokerage linking), Polygon.io (market data), Financial Modeling Prep (fundamental data), Amazon Web Services (hosting, payment delivery), and Anthropic (AI generation). Your use of the linked services is governed by their own terms and privacy policies. We are not responsible for and make no warranty about any third-party service.

Brokerage Linking. If you use the optional brokerage-linking feature, you authorize the third-party aggregator (currently SnapTrade) to retrieve read-only information from your broker. We never receive, store, or have access to your broker password. You can revoke brokerage linking at any time in the app settings or directly with the aggregator.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADESTREAK DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT.

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free;
• Market data will be accurate, complete, current, or free of latency;
• Scenario outcomes, AI mentor commentary, or any other output will be accurate or appropriate for your circumstances;
• Any errors or defects will be corrected;
• Any content downloaded from the Service will be free of viruses.

NO FINANCIAL, INVESTMENT, LEGAL, TAX, OR PROFESSIONAL ADVICE IS OFFERED OR IMPLIED. ANY DECISION YOU MAKE ABOUT REAL MONEY IS YOUR OWN. CONSULT A LICENSED FINANCIAL ADVISOR, CPA, OR ATTORNEY BEFORE MAKING INVESTMENT OR TAX DECISIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRADESTREAK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR DAMAGES ARISING FROM OR RELATED TO DECISIONS YOU MADE IN REAL-WORLD TRADING BASED ON OR INFLUENCED BY THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU ACTUALLY PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

This limitation applies even if a remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the foregoing limitations apply to the fullest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless TradeStreak, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including reasonable attorneys' fees) arising from:

• Your use of or access to the Service;
• Your violation of these Terms;
• Your violation of any third-party right, including intellectual property or privacy;
• Any User Content you submit;
• Any investment, trading, or financial decision you made based on or influenced by the Service.

12. Mandatory Arbitration and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

12.1 Agreement to Arbitrate

You and TradeStreak agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may (a) assert claims in small-claims court if they qualify, or (b) bring suit in court to enjoin infringement of intellectual-property rights.

12.2 Arbitration Administrator and Rules

The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Fredericksburg, Virginia or, at your election, via videoconference. Judgment on the arbitrator's award may be entered in any court having jurisdiction.

12.3 Class-Action Waiver

YOU AND TRADESTREAK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found unenforceable, then the entirety of this arbitration clause is null and void.

12.4 30-Day Opt-Out

You may opt out of this arbitration agreement by sending written notice of your opt-out to legal@tradestreak.app within 30 days of first accepting these Terms. Your notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out. Opting out of arbitration does not affect any other provision of these Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. To the extent a Dispute is not subject to arbitration under Section 12, the exclusive jurisdiction and venue will be the state and federal courts located in Fredericksburg, Virginia (City of Fredericksburg and the U.S. District Court for the Eastern District of Virginia, Richmond Division), and you consent to personal jurisdiction in those courts.

14. Modifications to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app and via email to the address on your account. The updated Terms will be effective as of the date stated in the header. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service and cancel any active subscription.

15. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. You may stop using the Service at any time. Sections 7, 9, 10, 11, 12, 13, and 17 survive termination.

16. Export Controls

The Service is subject to U.S. export control laws. You may not use, export, or re-export the Service to any country or person prohibited by U.S. law. You represent that you are not located in, or a national or resident of, any such country or on any U.S. government list of prohibited or restricted parties.

17. Miscellaneous

• Entire Agreement. These Terms, together with the Privacy Policy, Educational Use Disclaimer, and Risk Disclosure, are the entire agreement between you and TradeStreak concerning the Service and supersede all prior agreements.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign these Terms. We may assign these Terms without restriction.
• Force Majeure. Neither party is liable for delay or failure to perform caused by events beyond reasonable control (e.g., outages at cloud providers, acts of God, government action).
• Notices to You. We may give notice by in-app message, email, or posting on our website.
• Notices to Us. Written notice must be sent to legal@tradestreak.app or Provision Tech Advisors LLC, 11600 Heronview Dr, Fredericksburg, VA 22408, USA.
• Apple-Specific Terms. You and TradeStreak acknowledge that these Terms are between you and TradeStreak, not Apple. Apple has no obligation to furnish maintenance or support for the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
